AD: Thailand Canned Pineapple Fruit

The International Trade Administration is initiating and issuing the preliminary results of its antidumping duty changed circumstances review of canned pineapple fruit from Thailand, and its intent to revoke the AD duty order.

Sole Domestic Producer Has Ceased Production, ITA Intends to Revoke Order

According to the Thai Food Processors Association's (TFPA's) review request, Maui Pineapple Company, the sole domestic producer of canned pineapple fruit, has ceased the production of canning solid-pack pineapple fruit. The TFPA alleges that the AD duty order can no longer protect a domestic industry in the U.S. from material injury as required under the statute for the maintenance of an AD duty order.

Preliminary Revocation Effective Date of October 31, 2007

Therefore, the ITA is notifying the public of its intent to revoke the AD duty order with respect to imports of canned pineapple fruit from Thailand, effective October 31, 2007. If the ITA makes a final determination to revoke, it intends to instruct U.S. Customs and Border Protection (CBP) to liquidate without regard to AD duties and to refund any estimated AD duties collected, for all entries of canned pineapple fruit from Thailand made on or after October 31, 2007, the final date of production of the subject merchandise by the sole domestic producer. The ITA has determined that expedited action is warranted.

Current AD Duties Continue Until Final Determination to Revoke is Published

The current requirement for a cash deposit of estimated AD duties will continue unless and until the ITA publishes a final determination to revoke.
