AD: Chile IQF Red Raspberries
The International Trade Administration has issued a notice announcing that it is revoking the antidumping duty order on individually quick frozen (IQF) red raspberries from Chile due to lack of domestic interested party participation in the sunset review.

AD Duty Order Revoked Effective July 9, 2007
The ITA states that it is revoking this AD duty order effective July 9, 2007. It also states that it has notified the International Trade Commission (ITC) of its intent to issue a final determination revoking this AD duty order. The ITA will instruct U.S. Customs and Border Protection (CBP) to terminate the suspension of liquidation of the merchandise subject to this order with a time of entry on or after July 9, 2007. Entries of subject merchandise prior to July 9, 2007 will continue to be subject to suspension of liquidation and AD duty deposit requirements.
The ITA will complete any pending administrative reviews of this order and will conduct administrative reviews of subject merchandise entered prior to July 9, 2007 in response to appropriately filed requests for review.
(This revocation comes under the five-year (sunset) review process required by the Uruguay Round Agreements Act (URAA), which according to 19 CFR 351.218(a) requires the ITA to revoke an AD or CV duty order, or terminate a suspension agreement, after five years unless it is found that revocation would likely lead to both (1) a continuation or recurrence of dumping or a countervailable subsidy, and (2) material injury to a U.S. industry within a reasonably foreseeable time.
A negative determination either by the ITA with respect to (1) or by the ITC with respect to (2) results in the revocation of the AD and/or CV duty order.)
