Antidumping & Countervailing Duty Order Administrative Reviews Initiated

If one of the companies associated with these administrative reviews does not qualify for a separate rate, the ITA states that all other exporters of the subject merchandise from China who have not qualified for a separate rate are deemed to be covered by these AD duty administrative reviews as part of the single China-wide entity of which the named exporters are a part.

The ITA states that in the initiation notice that was published on April 5, 2006, Shanghai Xinike Trading Company was incorrectly initiated as Shanghai Xinke Trading Company for all product categories with respect to the AD case.

Requests to revoke in part. According to the ITA, it has also received timely requests to revoke in part the AD duty order on stainless steel bar from Germany and to revoke in part the CV duty orders on low enriched uranium from Germany, the Netherlands and the United Kingdom. The ITA notes that the revocation requests for low enriched uranium from Germany, the Netherlands and the United Kingdom were inadvertently omitted from the initiation notice that was published on April 5, 2006.

Requests between certain anniversaries of publication. The ITA states that during any administrative review covering all or part of a period falling between the first and second or third and fourth anniversary of the publication of an AD duty order under 19 CFR 351.211 or a determination under 19 CFR 351.218(f)(4) to continue an order or suspended investigation (after sunset review), the Secretary of Commerce, if requested by a domestic interested party within 30 days of the date of publication of the notice of initiation of the review (in this case, within 30 days of April 28, 2006), will determine whether AD duties have been absorbed by an exporter or producer subject to the review if the subject merchandise is sold in the U.S. through an importer that is affiliated with such exporter or producer.

The ITA notes that the request must include the name(s) of the exporter or producer for which the inquiry is requested.

The ITA intends to issue the final results of these reviews not later than March 31, 2007.
