AD: Mexico Gray Portland Cement and Clinker

The International Trade Administration (ITA) has issued a number of notices that collectively implement a portion of the three-year Agreement on Trade in Cement with respect to the antidumping (AD) duty order on gray portland cement and clinker from Mexico.

New AD cash deposit rate for CEMEX & GCCC effective April 3, 2006. The ITA has instructed U.S. Customs and Border Protection (CBP) to change the estimated AD duty deposit rate for CEMEX S.A. de C.V. (CEMEX) and GCC Cemento, S.A. de C.V. (GCCC) to $3.00 per metric ton, for subject cement produced or exported by CEMEX or GCCC that has a time of entry on or after April 3, 2006.

Liquidation of numerous CEMEX and GCCC entries. The ITA has also instructed CBP to liquidate at the rate of $0.10 per metric ton, entries of subject cement produced or exported by CEMEX or GCCC, for the following periods:

August 1, 2005 - April 2, 2006
August 1, 2004 - July 31, 2005
August 1, 2003 - July 31, 2004
August 1, 2002 - July 31, 2003
August 1, 2001 - July 31, 2002
August 1, 2000 - July 31, 2001
August 1, 1999 - July 31, 2000
August 1, 1998 - July 31, 1999
August 1, 1997 - July 31, 1998
August 1, 1995 - July 31, 1996

Outstanding NAFTA Panels terminated, etc. The ITA has also issued notices that terminate ten NAFTA panel reviews and stay one NAFTA panel review.

(The Agreement provides for a new AD cash deposit rate for CEMEX and GCCC effective April 3, 2006, a new assessment rate through April 2, 2006, three years of subregional export limits beginning on April 3, 2006, licenses from Mexico and license numbers from the ITA, the revocation of the AD order on April 1, 2009, etc. See ITT's Online Archives or 03/16/06 news, 06031625 for BP summary.)
