AD: China Certain Cased Pencils

The International Trade Administration (ITA) is revoking in part the antidumping (AD) duty order on certain cased pencils from China with respect to the pencils described below.

The ITA states that it is partially revoking this AD duty order due to the request of M.A. Notch Corporation (Notch), a U.S. importer, and because domestic interested parties have expressed no objection to the exclusion of these pencils from the AD duty order.

As a result, the ITA states it will terminate the suspension of liquidation for pencils meeting the specifications described below, effective March 15, 2006. It will also instruct U.S. Customs and Border Protection (CBP) to liquidate without regard to AD duties all unliquidated entries of this merchandise, and to refund with interest any estimated AD duties collected on this merchandise with a time of entry prior to March 15, 2006.

Modification (Added Exclusion) to the Scope of the Order. The ITA has amended the scope of the AD duty order to exclude pencils with the following physical characteristics: novelty jumbo pencils that are octagonal in shape, approximately ten inches long, one inch in diameter before sharpening, and three-and-one eighth inches in circumference, composed of turned wood encasing one-and-one half inches of sharpened lead on one end and a rubber eraser on the other end.
