AD/CV: Canada Hard Red Spring Wheat

Effective January 2, 2006, the International Trade Administration (ITA) is revoking the antidumping (AD) and countervailing (CV) duty orders on hard red spring wheat from Canada and terminating the suspension of liquidation.

AD & CV Duty

On December 12, 2005, the binational panel convened under the North American Free Trade Agreement (NAFTA) issued a decision affirming the International Trade Commission's (ITC's) remand determination that the domestic industry is neither materially injured by reason of the of the subject imports nor threatened with such injury. Suspension of Liquidation is Terminated Effective January 2, 2006

The ITA states that it will instruct U.S. Customs and Border Protection (CBP) to terminate the suspension of liquidation of hard red spring wheat from Canada, effective January 2, 2006; to cease collection of AD and/or CV cash deposits on hard red spring wheat from Canada; and to proceed with liquidation of the subject merchandise which entered the U.S. on or after January 2, 2006, without regard to CV and AD duties.

The ITA adds that revocation does not affect liquidation of entries made prior to January 2, 2006. Any entries of subject merchandise entered before January 2, 2006, are subject to administrative review. If no review is requested, the ITA will liquidate at the rate in effect at the time of entry pursuant to 19 CFR 351.212(c).
