AD: China Certain Cased Pencils

The International Trade Administration (ITA) has issued its preliminary results of an antidumping (AD) duty changed circumstances review of the AD order on certain cased pencils from China.

ITA Preliminary Determines that Certain Large Novelty Pencils Should Be Excluded

The ITA preliminarily finds that cased pencils meeting the following description should be excluded from the AD order: novelty jumbo pencils that are octagonal in shape, approximately 10 inches long, one inch before sharpening, and three-and-one eighth inches in circumference, composed of turned wood encasing one-and-one half inches of sharpened lead on one end and a rubber eraser on the other end.

As a result, the ITA is notifying the public of its preliminarily intent to revoke the AD duty order, as it pertains to novelty pencils that meet the description above. In addition, the ITA states that upon publication of the final results of this AD changed circumstances review, if there are no changes from the preliminary results, it intends to modify the scope of the AD order to reflect this exclusion.

(The ITA notes that if the final partial revocation occurs, it intends to instruct U.S. Customs and Border Protection (CBP) to liquidate without regard to AD duties all unliquidated entries of subject merchandise that meet the above-noted exclusion, and to refund with interest any estimated AD duties collected on such merchandise with a time of entry on or after December 1, 2001.)
