AD: Italy Certain Pasta

The International Trade Administration (ITA) has issued the final results of its antidumping (AD) duty administrative review of certain pasta from Italy for the period of July 1, 2003 through June 30, 2004.

Revocation of AD Duty Order for Pallante

The ITA has determined that Pastificio Antonio Pallante S.r.L. and its affiliate Vitelli Foods LLC (Pallante) qualify for revocation of the AD duty order on subject merchandise from Italy. As a result, this AD duty order will be revoked with respect to subject merchandise produced and exported by Pallante.

(Although ITA sources previously indicated that this revocation would not apply to Pallante's affiliate, Vitelli Foods LLC, ITA sources now state that this revocation also applies to Vitelli Foods LLC).

(a) The ITA has determined that a de minimis AD duty rate of 0.34% exists. As noted above, the AD duty order is being revoked for Pallante, effective November 29, 2005.

(b) The ITA states that for previously reviewed or investigated companies not listed above, the AD duty cash deposit rate will continue to be the company-specific rate published for the most recent period;

(c) If the exporter is not a firm covered in this review, a prior review, or the original AD investigation, but the manufacturer is, then the AD duty cash deposit rate will be the rate established for the most recent period for the manufacturer of the merchandise; and

(d) The cash deposit rate for all other manufacturers or exporters will continue to be 11.26%, the "All Others" rate established in the AD investigation.

Assessment Instructions for the Review Period (07/01/03 - 06/30/04)

The ITA states that it will issue appropriate assessment instructions directly to CBP within 15 days of November 29, 2005. Additionally, the ITA states it has calculated exporter/importer-specific duty assessment rates, which according to trade sources, may differ significantly from the AD cash deposit rate listed above.

The ITA notes that where the assessment rate is above de minimis, it will direct CBP to assess duties on entries of subject merchandise by that importer.
