ITA Initiates Changed Circumstances Review Due to Possible False Sales Info
The ITA explains that it is self-initiating this AD duty changed circumstances review based upon information contained in a recent federal court decision, Goss International Corp. v. Tokyo Kikai Seisakusho, Ltd. (TKS). In this decision, the ITA states that evidence was presented demonstrating that TKS provided false information regarding certain sales that were the subject of the ITA's 1997-1998 AD duty administrative review of subject merchandise from Japan.
The ITA explains that final results of the 1997-1998 AD duty administrative review were a factor in the ITA's January 16, 2002 decision to revoke the AD duty order with respect to TKS as well as its February 25, 2002 decision to revoke the AD duty order under a five-year sunset review.
According to the ITA, interested parties may submit comments on this AD duty changed circumstances review and the actions the ITA should take not later than 30 days after May 10, 2005. Any responses to these comments must be received not later than 7 days following that submission of the comments. The ITA states that it will publish in the Federal Register a notice of preliminary results of AD duty changed circumstances review, which will set forth the factual and legal conclusions upon which its preliminary results are based, and a description of any action proposed based on those results.
