AD: Korea Certain Polyester Staple Fiber

The International Trade Administration (ITA) has issued the final results of the antidumping (AD) duty administrative review of certain polyester staple fiber from Korea for the period of May 1, 2002 through April 30, 2003.

Revocation of AD Duty Order for One Company

The ITA has determined that Keon Baek qualifies for revocation of the AD duty order on certain polyester staple fiber from Korea pursuant to 19 CFR 351.222(b)(2) and that the order, with respect to subject merchandise produced and exported by Keon Baek, should be revoked.

As a result, the ITA is terminating the suspension of liquidation for certain polyester staple fiber produced and exported by Keon Baek with a time of entry on or after May 1, 2003. The ITA states that it will instruct U.S. Customs and Border Protection (CBP) to refund with interest any cash deposits for such entries.

AD Cash Deposit Rate for a Time of Entry On/After 10/18/04

For shipments with a time of entry on or after October 18, 2004, suspension of liquidation will continue for the below listed companies (except Keon Baek) at the AD duty cash deposit rates (weighted-average margins) listed below:

(a) Keon Baek has a de minimis AD rate of 0.07% and is exempt from the collection of cash deposits and the suspension of liquidation due to its revocation from this AD duty order.

(b) for previously reviewed or investigated companies not listed above, the cash deposit rate will continue to be the company-specific rate published for the most recent period;

(c) if the exporter is not a firm covered in this review, the previous review, or the original investigation, but the manufacturer is, the cash deposit rate will be the rate established for the most recent period for the manufacturer of the merchandise; and

(d) if neither the exporter nor the manufacturer is a firm covered in this or any previous reviews, the cash deposit rate will be the "all others" rate of 7.91%.

Assessment Instructions for Review Period (05/01/02 - 04/30/03)

The ITA shall determine, and CBP shall assess, AD duties on all appropriate entries of subject merchandise from Korea. The ITA states that it will issue appropriate assessment instructions to CBP within 15 days of October 18, 2004.
