AD: China Heavy Forged Hand Tools

The International Trade Administration (ITA) has issued the final results of the following antidumping (AD) duty administrative reviews of heavy forged hand tools, finished or unfinished, with or without handles (heavy forged hand tools) from China for the period of February 1, 2002 through January 31, 2003.

(b) For any previously review or investigated China or non-China exporter, not covered in these reviews, with a separate rate, the cash deposit rate will be the company-specific rate established in the most recent segment of these proceedings;

(c) For all other China exporters, the cash deposit rates will be the all others rates established in the final results of these AD duty administrative reviews;

(d) For any non-China exporter of subject merchandise from China who does not have its own rate, the cash-deposit rate will be the one applicable to the China exporter who supplied the non-China exporter.

The ITA states that the "all others" rates for the final results of these AD duty administrative reviews are as follows: axes/adzes, 55.74%; bars/wedges, 139.31%; hammers/sledges, 27.71%; and picks/mattocks, 98.77%.

Determination Not to Revoke AD Duty Order in Part with Respect to SMC & LMC/LIMAC

With respect to hammers/sledges from SMC and bars/wedges from LMC/LIMAC, the ITA has determined that they do not qualify for revocation of the respective AD duty orders.

Assessment Instructions for Review Period (02/01/02 - 01/31/03)

The ITA states that it will instruct U.S. Customs and Border Protection (CBP) to liquidate entries of the subject merchandise during the review period that are from the above-listed companies at the calculated importer-specific per-unit assessment rates (unless the importer specific assessment rate is zero or de minimis (i.e., less than 0.50%), in which case liquidation will occur without regard to AD duties).

For all shipments of subject merchandise for the four AD duty orders covering heavy forged hand tools from China, exported by the respondents and imported by entities not identified by the respondents in their questionnaire responses, the ITA will instruct CBP to assess AD duties at the cash deposit rate in effect on the date of entry.

The ITA also states that for the respondents receiving AD duty rates based upon adverse facts available (AFA), the ITA will instruct CBP to liquidate entries according to the AFA rate.
