AD: China Bulk Aspirin

The International Trade Administration (ITA) has initiated an antidumping (AD) duty changed circumstances review and has preliminarily determined to revoke the AD duty order on bulk aspirin from China.

Intent to Revoke AD Duty Order

The ITA states that it intends to revoke this AD duty order because it has preliminary determined that the continued relief provided by the order with respect to bulk aspirin from China is no longer of interest to the domestic interested party in these proceedings.

Among other things, the ITA states that Bimeda, Inc., a U.S. importer of subject merchandise, asserts that Rhodia, Inc., the only petitioner in the original investigation and the only U.S. producer at the time the order was issued, had closed its sole production facility related to the manufacture of bulk aspirin in the U.S.

According to the ITA, if revocation of this AD duty order occurs, it intends to instruct U.S. Customs and Border Protection (CBP) to liquidate without regard to AD duties all unliquidated entries of bulk aspirin and to refund (with interest) any estimated AD duties collected on all entries of bulk aspirin that have a time of entry on or after July 1, 2003 (the earliest date for which entries of bulk aspirin have not been subject to an administrative review.)

Current AD Cash Deposit Requirement Continues

The ITA states that with respect to this AD duty changed circumstances review, the current requirement for an AD cash deposit on bulk aspirin from China will continue unless and until the ITA publishes a final decision to revoke the AD duty order.
