Census Has Put Plans for a AES Filer License and Permit Program "On Hold
According to U.S. government sources, the Bureau of Census (Census) has put its plans for an Automated Export System (AES) filer license and permit program "on hold" in light of Census' upcoming plans to mandate filing through AES for all exports that require Shipper's Export Declaration (SED) information.

One source stated that this hold action may be due to Census concerns that any revocation of an AES filer's license could revoke the filer's actual exporting privileges; an outcome that Census would want to avoid. Sources add that Census would likely only reconsider such a program if it decides that revoking a filer's license does not also revoke the filer's exporting privileges.
(In spring 2003, Census sources announced plans to implement a new AES filer license and permit program. As previously described by Census, the program would have required all companies (e.g., U.S. principal parties in interest (USPPIs), freight forwarders, and other agents (non-vessel operating common carriers (NVOCCs), consolidators, etc.) filing through AES to have at least one licensed individual at each filing location. In order to obtain an AES filer license, Census had previously stated that an individual would have to, among other things, pass a license exam and background check.
Census had further stated that the AES filer license would be an individual license. Companies that file in AES would have had to have a permit, in addition to having a licensed individual at each filing location. Sources have previously stated that they had not expected to implement the AES filer license and permit program until 2005.
