AD: Industrial Nitrocellulose from Six Countries

The International Trade Administration (ITA) has initiated changed circumstances antidumping (AD) duty reviews to consider revoking the AD duty orders on industrial nitrocellulose (INC) from China, France, Germany, Japan, South Korea, and United Kingdom, due to requests to the revoke the AD duty orders.

The ITA states that on February 12, 2004, Wolff Cellulosics GmbH (Wolff), a German manufacturer of INC, filed a request for an AD duty changed circumstances review for INC from Germany. The ITA also states that on March 9, 2004, Valspar Corporation (Valspar), an importer of INC and an interested party in multiple proceedings, filed requests for AD duty changed circumstances reviews of INC from China, France, Germany, Japan, South Korea and United Kingdom.

According to the ITA, both Wolff and Valspar stated that no domestic producer of INC currently exists. Valspar, therefore, claimed that revocation of the AD duty orders is warranted due to the lack of interest on behalf of the U.S. industry.

Specifically, Wolff asserts that Green Tree Chemical Technologies, Inc. (Green Tree), the sole producer of domestic like product, has ceased production and no longer maintains the capacity to produce INC, and Valspar claims that in November 2003, without prior announcement, Green Tree closed its INC production facility.

The ITA states that while these AD duty changed circumstances reviews are underway, the current requirement for a cash deposit of estimated AD duties on all subject merchandise will continue unless and until it is modified pursuant to the final results of these AD duty changed circumstances reviews.
